1. GENERAL INFORMATION ABOUT PIXERAL

Pixeral is a platform for AI-powered image generation and editing, virtual try-ons, and creative scene building provided by AEFLUX INC. ("we", "us" or "our"). These terms of service for Pixeral (the "Terms") form a binding agreement between you ("you") and us regarding the use of and access to the services described herein.

By creating an account on our website (https://www.pixeral.com) and using the Services (as defined below), you confirm that you’ve read and understood the Terms and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. You also affirm you have the authority to enter into a legally binding agreement.

2. WHAT SERVICES ARE PROVIDED BY PIXERAL?

Pixeral empowers creators and brands with AI tools to generate, enhance, and transform visuals — including virtual try-ons, scene generation, masking, background removal, and other creative features (“Services”).

You can build product shots, fashion mockups, marketing assets, and enhance your assets through AI upscaling. We may offer content suggestions based on your activity.

Subject to your compliance with these Terms, we grant you a non-exclusive and non-transferable right to access and use the Services solely for your internal business or personal use during your active subscription period.

Depending on the subscription plan you choose, you may be able to invite others to use the Services under your account (“Authorized Users”). You agree to remain responsible for all activity conducted by Authorized Users and to immediately notify us of any unauthorized use.

We use commercially reasonable efforts to make the Services available 24/7. Occasionally, we may need to suspend availability to address technical issues or comply with legal requirements. In non-urgent cases, we will notify you in advance of any such suspension.

3. HOW TO SET UP AN ACCOUNT & SUBSCRIPTION

To access and use the Services, you must create an account. Accounts are personal and cannot be transferred or shared. Once your account is created and payment is completed (if applicable), Services will be available to use.

You may use Pixeral through a limited free version or by subscribing to a paid plan for enhanced features. See pricing and subscription details at https://www.pixeral.com/#pricing.

4. WHAT ARE YOUR OBLIGATIONS?

You agree to use the Services in accordance with these Terms, applicable laws, and any usage guidelines we provide. You may only access Services through our provided interfaces. Sharing account credentials or unauthorized access may result in termination.

You’re responsible for any content you or your users upload, including generated images. You may not use the Services to create or share infringing, harmful, or misleading content. This includes impersonation, explicit imagery, hate speech, or misinformation.

When uploading content, you affirm that you have appropriate rights to use it. If your account is used in a way that violates any rights or laws, you agree to indemnify Pixeral against resulting claims or damages.

If you delete content, Pixeral may retain backups for audit and reliability purposes. Depending on your settings, your content may be visible to others.

We are not responsible for third-party services integrated with Pixeral. Such services may be governed by their own terms.

Pixeral uses third-party AI APIs such as Replicate and FAL AI. Use of such services is subject to their respective licensing terms and acceptable use policies.

5. WHO OWNS WHAT?

All content, branding, tools, and code related to the Website and Services are owned by AEFLUX INC. or our licensors. You may not reproduce, modify, or redistribute our proprietary materials without explicit written permission.

If an image is created primarily by your input, you own the rights under applicable law.

For AI-generated content where Pixeral’s models contributed significantly, rights are granted to you as much as applicable law allows. However, we cannot guarantee you will own copyright in all jurisdictions or that your content won't potentially infringe third-party rights.

You grant Pixeral a non-exclusive, worldwide license to use, display, process, and store your content and generated images to operate and improve the Services, support your account, and allow sharing where enabled.

If you collaborate with other users, you grant them a license to use and modify shared content.

Any feedback you share can be used by Pixeral without restriction or compensation.

6. WHAT ARE THE PAYMENT TERMS?

Pixeral operates on a subscription basis. You pay monthly or yearly in advance. See current pricing at https://www.pixeral.com/#pricing. All prices are displayed before checkout and may exclude taxes unless otherwise stated.

Payments are processed through a secure third-party payment provider. We do not store or have access to your full payment card information.

By completing a purchase, you agree to the payment provider’s terms of service and any applicable billing policies presented at checkout.

You may cancel your subscription at any time and will retain access until the end of the current billing period.

Failure to complete payment may result in suspension or termination of access to the Services.

7. FOR HOW LONG DOES A SUBSCRIPTION LAST?

Subscriptions begin on payment and auto-renew each month or year depending on the plan. You can cancel in your account settings at any time.

After cancelation, you retain access for the remainder of your term, then downgrade to a free plan. To fully deactivate your account and have personal data removed, contact support.

8. REFUND POLICY

Refund requests must be submitted via a support ticket to support@pixeral.com within 14 days of the original subscription start date or the most recent renewal date, whichever is later. Requests made after this period may not be eligible for review.

Pixeral reserves the right to review account activity and validate fair usage before issuing any refund. Refunds may be prorated based on unused credits and verified account behavior. In cases where abuse, misuse, or excessive usage of the services is detected, refunds may be denied.

If a refund is granted, all credits and access granted under the original subscription will be revoked, and any paid features will become inaccessible. Alternatively, users may cancel their subscription without requesting a refund and retain access to paid services until the end of the billing cycle.

9. WHAT IS OUR LIABILITY?

Pixeral is provided “as is” and “as available” with no warranty of uninterrupted service. Report issues to support within 2 months to qualify for any remedy.

We use secure infrastructure (e.g. AWS) but recommend you maintain your own backups. We are not liable for data loss.

No liability for indirect, incidental, or consequential damages.

Maximum liability: USD $100, or $0 for free-tier users.

We’re not liable for delays caused by events outside our control (e.g., internet outages, platform providers).

10. ACCEPTABLE USE AND AI SAFEGUARDS

Use of the Services, including Pixeral’s AI-powered features, must comply with applicable law and our Community Guidelines, which are incorporated by reference into these Terms.

Pixeral employs automated moderation systems to evaluate user inputs for content generation, aiming to prevent misuse and ensure outputs align with our safety standards.

You may not use the Services to:

• Generate deceptive, misleading, or impersonating content (e.g., fake individuals, endorsements, or credentials)

• Create explicit or sexually suggestive material intended to arouse or exploit

• Violate intellectual property, privacy, or publicity rights

• Circumvent content moderation systems or produce hateful, violent, or otherwise harmful outputs

We reserve the right to suspend or terminate access if we determine that AI features are used in a manner inconsistent with these Terms, the Community Guidelines, or applicable regulations.
